Dear Candidate,
In compliance with the provisions of REGULATION (EU) 2016/679 (hereinafter “GDPR”) and applicable national legislation (Legislative Decree 2003/196 as amended by Legislative Decree 101/2018 hereinafter “Privacy Code”), we inform you that the data you have provided to apply for our open position will be processed by Kube Partners Italy s.r.l. which operates as Data Controller of personal data (hereinafter “Owner”). The Data Controller has appointed its own DPO, Avv. Laura Marretta, who can be reached at the following e-mail address: privacy@kubepartners.com.
The Data Controller adopts, as required by Art. 12 GDPR, the following information as a measure to provide the data subject, as job applicant, with the information referred to in Art. 13 and the communications referred to in Art. 15 to 22 and 34 of the GDPR.
Therefore, in relation to the above, the Data Controller informs you that the personal data you provide will be processed in accordance with the provisions of the GDPR and the Privacy Code, based on the principles applicable to the processing of personal data as described in Article 5 of the GDPR (i.e. principles of correctness, relevance, transparency, adequacy, protection of confidentiality and rights, etc.).
The processing is carried out on the basis of the legal conditions provided for in Article 6 of the GDPR regarding the purposes inherent in the relationship established with the Data Controller. Consequently, its legal basis, as required by Art. 13 c) of the GDPR, is justified by the reasons for which the relationship with the Data Controller is established, i.e. in this case, following the receipt of your Curriculum Vitae, which you have sent us, to verify the possibility of establishing a working relationship with our company (Art. 6 paragraph 1 b) of the GDPR).
With this in mind, we inform you that the processing of the data provided will include its management, organization, its use within the EU and outside the EU (within the limits of Chapter V of the GDPR), storage, consultation, use, comparison, extraction, destruction and modification of the data processed following a request by the interested party, cancellation and communication to members of the organizational structure of the Data Controller (including those Authorized as well as Managers).
The processing of data may be carried out both in paper and electronic form only by persons specifically authorised to do so.
During the selection and/or internship period, Kube Partners Italy s.r.l. reserves the right to monitor the “social profiles” of the interested parties on a non-generalized basis.
The data you provide will not be disclosed by the Data Controller. Your data may also be passed to Authorised Parties or our Managers for the purposes set out above.
The Data Controller does not carry out processing on the basis of any decision-making process on an automated or profiling basis.
For the purposes of the provisions of Article 13 paragraph 2 a), we inform you that your data, if you do not pass the interview process, will be kept for 1 year in order to verify whether you are suitable compatible for other positions that may open up in the short term.
Data breach: In the event that the Data Controller suffers a violation as configured in Art. 33/34 involving a risk to the rights and freedoms of an individual (data breach) then action will be taken – if necessary – to notify the Guarantor Authority and will communicate the incident to all interested parties.
The Data Controller hereby informs you that you are guaranteed the rights expressed in Article 13 paragraph 2 of the GDPR and therefore: • The right of access to personal data and related information listed under Article 15 of the GDPR;
- The right to rectification or cancellation of the data provided or the limitation of processing;
- the right to object to processing;
- the right to data portability where the processing is based on Article 6(1)(a) or Article 9(2)(a);
- the right to withdraw consent at any time without prejudice to the legal processing based on the consent given before its withdrawal;
- the possibility of lodging a complaint with a supervisory authority.
You may exercise the rights listed above, or request further information, by sending an e-mail to the DPO at the following e-mail address privacy@kubepartners.com, indicating in the subject line: “exercise of rights pursuant to GDPR” and inserting in the body of the e-mail the right you wish to exercise, as well as your name, surname and e-mail address where you wish to receive the response from the Data Controller.
Once the Data Controller has processed what has been received, you will be sent a response within the terms indicated in Article 12, paragraph 3 of the GDPR.
The Data Controller also advises that if she intends to further process personal data for a reason other than that for which it was collected, before such further processing she will provide the data subject with information about this different purpose and any further relevant information by requesting, if necessary, specific consent.
